REPORT - 2008 American Liberty Council Putting the Government Back in the Box

 

RestoreTheRepublic.com | By Michael LeMieux | On Saturday 11 October, 2008 in Houston Texas, a select number of freedom loving patriots joined together to discuss the current state of our country and how we can move the Patriot Movement forward. Representing Restore the Republic was Gary Franchi and Michael LeMieux.

With over 20,000 organizations, of all sizes, crying for freedom with a sincere desire to correct the state of our government and to educate the people; the sad fact remains that we have not made the kind of impact we need to make.

 

 

 

 

 

 

 

 

Each organization is pushing hard to accomplish their individual goals but without unity of effort we are like grains of sand blowing in the wind amounting to not much more than an irritant to the government.

 The aim of this conference was to present a plan by which we can unite behind a national effort to make a serious and lasting change. What follows below is a brief synopsis of the conference and the plan to assist all patriots in our effort to return America to the land envisioned by our Forefather and guaranteed to us in the Constitution.

 

Restore the Republic has offered to play a central role in the movement by providing the all critical communications arm of the movement. This will allow all our members the opportunity to assist in this historic movement and provide the opportunity to not only learn but to act in our struggle to take America back.

 

 

 

 

Speakers at the conference included:

 

 

 

• Dave VonKleist – Patriot singer and songwriter who emceed the event
• Jim Cabaniss from American Veterans in Domestic Defense (AVIDD)
• Larry Becraft – Tax attorney and national leading legal authority on tax law
• Joseph Banister from freedomabovefortune.com a former IRS CID Special Agent
• Tom Cryer - Trial attorney and Truth Attack founder
• Pastor Joe Larson - who opened and closed the event

 After the opening remarks Tom Cryer took the stage and discussed the issue of government boundaries and how our forefathers designed a government with specific enumerated powers and limits. He also stated that of all the powers identified to the various factions of our society the one the founders failed to enumerate was the powers of the people

Mr. Cryer’s talk included the following points:  

 

 

 

 

• The 17th Amendment destroyed the bicameral legislature
• In 1913 we saw the birth of the Federal Reserve, the Sixteenth and Seventeenth Amendments, which was not by coincidence.
• State sovereignty has been all but abolished
• We have lost all personal liberty to regulation and license
• The US is controlled by other countries by way of treaties and banking
• The separation of government powers is gone at all levels of government
• Greed within government is expanding
• The military force at the disposal of government precludes winning an armed insurrection.
• Because keeping the government in check is the responsibility of the people it is us who have failed the government and our posterity.
• The government has expanded because we have allowed it to. It is the nature of government to do so, it always has and it always will, until stopped by the governed. 

 

 

 

 

Mr. Jim Cabaniss from AVIDD, after telling the history of AVIDD, then spoke on the following: 

 

 

• Why we have not been able to turn things around.
• We are very good at identifying the problems but we don’t seem to work well together.
• Patriots’ are poor and it takes money to accomplish the goals we seek.
• Government is well organized, well funded, (by our money) and has the benefit of generations of existence.
• To overcome the obstacles to regaining our liberty we must stand together and put aside our egos, we MUST stand united or we will fall individually.
• Even though our individual missions may differ we are agreed on the overall mission and we must support those that are spearheading the effort to return the monster back to the box.
• If our founders were willing to give their lives, their fortunes, and their sacred honor in the cause of freedom – what is the matter with us! 

 

 

 

Larry Becraft spoke on the financial situation we are facing and the position of the IRS. He spoke on money issues, the credit crises, the looming Hyper-inflation, taxation and how hyper-inflation will trigger increased taxation to cover the deficit. He went on to speak of the bloated government and its cost, but pointed out that “income tax” only accounts for 30% of the total overall intake of funds to the government. 

 

 

His talk also included the following topics: 

 

 

 

 

• Where is the constitutional power to tax the individual for their exchange of labor
• By striking at the financial bloodline we can kill the beast.
• We must continue the Ron Paul Revolution
• No other issue in the Patriot Movement affects the people more directly than taxation
• People are out of tune with the issues – but the efforts made thus far is starting to educate and turn the people around
• People must also want to remove the chains of slavery. He related that some people don’t want to give up taxes because they enjoy the tax refund they get each year. We must continue to educate the people.
• If we continue to keep gong down the road we are on we will see continued degradation of society, riots and crime waves unlike any in history of our nation. The government will respond in kind to maintain order and discipline causing even more abuse of our liberty.
• The largest issue that effects both government and the people is the tax issue
• We must train more paralegals in the tax field to push the movement forward
• He displayed documentation that stated their was not requirement for individuals to pay income tax. And that taxation was based solely on the peoples “belief” that tax laws are placed on everyone. 

 

 

 

Joe Banister spoke on the need to unite all of us to fight the beast. He spoke of the realization that if the government could do the things that were done to him and Tom Cryer than they could do it to any American.

 Joe also spoke on the fact that there is absolutely no law that makes the normal citizen in this country liable for income tax. We have all heard the stories of letters and petitions sent to the IRS and Congress demanding the government show us the law, and we have been answered by silence. He also discussed the fact that there is no law that defines earnings as income.

 

 

 

 

One of the last points, and one I found very interesting, is that according to the Supreme Court the government cannot tax a right or the free exercise thereof. We have the right to work, the right to property, the right to due process, and the right to contract. Each of these rights is directly violated by the mal-enforcement income tax.

The Supreme Court has said that your time and talents are your property. If the employment of those properties is a right then the taxing of them is a violation of the Supreme Court ruling and an affront to the Constitution. 

 

 

 

 

THE PLAN 

 

 

 

 

Tom Cryer presented the plan as follows: 

 

 

 

 

1. Issues are important, but many times they are only a symptom of the underlying root problem.
2. We must take problems 1 at a time and focus enormous effort to correcting that problem.
3. We should start with taxes – The government puts more effort into the Tax Honesty Movement than any other item, because it is there most vulnerable spot.
4. Take away the governments ability to rob the American people and the rest of the problem areas become weaker.
5. There are 3 divisions, or fronts, to the plan  
   1. Legal
   2. Political
   3. Public Relations 

 

 

 

The Legal Front: 

 

 

 

 

• Go on the offensive at all levels
• Provide defense to those in need
• File lawsuits at every opportunity
• Put Pressure on Law Review organizations
• Educate other attorneys
• Utilize 7431 & 7433 actions – violations of IRS law by government officials
• Support those that are in the fight.
• Support public defenders and educate them on how to help in IRS cases
• Challenge withholding – this is a current project
• Press for informed juries
• When judges break the law we must enforce administrative conflict resolutions and utilize/train court watchers
• Public Rights Education
• Perform 7431 screens to fire IRS agents who violate the law
• File Treasury Inspector General for Tax Administration (TIGTA) complaints and violation concerns whenever possible. 

 

 

By going on the offensive with the IRS we place them on the defensive and make sure they follow the law at every turn. When IRS agents start losing their jobs because they have exceeded the bounds of their authority the next agent will act more in line with the law. As judges start seeing administrative suits about their conduct it hurts their chances for re-election and places marks on their record with the bar. All of this reigns in the abuse of power they now dispense upon the American people. 

 

 

 

 

The Political Front: 

 

 

 

 

• The AMUC Awards – America’s Most Unwanted Congressmen: This award is publicly awarded to the worst congressmen in an election year. Press releases will be sent to ALL major outlets, both print and television.
• Create Insecure Politicians – by using the truth to politically assassinating the politician with his voting record, his own statements, and any dirt from his past. We will canvas his district with door to door handouts, posters, print media advertisements, and internet campaigns to let the people know just what kind of people they are voting into office.
• Support Constitutionalist’s for office - We must place like minded people into office that can withstand the corrosive effects of power and have the moral courage to stand up for the Constitution and the founding principles of this Great Nation.
• We must introduce new legislation that forces the government to obey the constitution. A prime example is the enumerated powers act that would require any proposed bill to state foremost the Constitutional power than entitles the government to pass such a bill.
• Support of operation Stop Thief.
• Lobby Washington for Constitutional issues.
• Robo-Calling to inform the public of important issues.
• Pardon petition drives asking for signatures to release political prisoners.
• Blame IRS “publicly” for the ills felt by many Americans.
• Letter writing blitz’s
• Educate the IRS employees themselves of the abuse of our tax system. 

 

 

 

The Popular Front: 

 

 

 

 

• Publicize the AMUC awards far and wide
• Operation Stop Thief every April 15th
• Letters to leaders at all levels of government
• Inform the local media
• Press releases
• Robo-Calling
• Court Observers to keep track of violations of law and to hold public servants accountable to the people.
• Publications that speak the truth and articles in publications that make the citizenry aware of the problem
• Word of mouth
• Form publishing companies and start spreading the word
• Utilize free media appearances as an opportunity to spread the word
• Utilize demonstrations to garner public attention to the issues
• We must strive for accountability and transparency in all we do
• Hold petition drives to garner support and awareness of the issues 

 

 

 

In order to ensure our success we must follow the successful processes of all reform movements: 

 

 

 

 

1. Propounding the issue – by placing it squarely in the face of the American people. We must create a stir around the issue that the news media and the people will hear about it and want to know more.Create the buzz that gets people talking around the water cooler.
2. Stimulate public discussion – by placing enough energy around the issue people start to discuss and take sides of the issue. The more people talk about an issue the more prevalent it becomes in the minds of society.
3. Political pressure from within the movement as well as those from the previous step will cause increased awareness and response.
4. Promote change by offering the political arm of government the opportunity to respond to the demands of the people. 

 

 

 

Truth Attack (www.truthattack.org) has stepped forward to lead this great effort, and although some may feel this does not go quite far enough, it is a giant step in the right direction. With enough support from the Patriot and Tax Honesty movement groups and supporters we can make a big impact on the political landscape of this nation. 

 

 

 

 

Truth Attack has stepped forward to provide: 

 

 

• Coordination of the efforts listed above
• Fund Raising to support those efforts
• A single voice to both the government and the people
• Motivation for all the patriots in returning our country to the people
• Activate organization and individuals to assist in the effort
• Direct activities as necessary
• Rapid Action and Reaction to events as they unfold
• Lobbying efforts within Washington to ensure our message and demands are heard 

 

 

 

So, what is required of us? 

 

 

 

 

• Primarily ACTION and support – with the emphasis on action. This will be a call to action to DO not to just talk. We are not just looking to educate the public or even the government. This is a movement of action and accomplishment.
• Gather information and ideas. As we progress information and calls for information will go out to gather as much intelligence about what is going on around us. We must be willing to go out into our local communities and learn what our state and local officials are doing as our national representatives, and report back.
• We must be willing to disseminate the information we get to as many people as possible to spread the word of our efforts. As we succeed more people will be drawn to our effort and our message will spread like wildfire.
• Reinforce Leadership – when necessary take up the cause personally and follow the example of Truth Attack leadership locally. Support those fighting the fight by doing whatever we can to make our efforts felt and successful.
• Assist in fundraising. As with any venture it does not come free. For those that can give what you can. For those that cannot, spread the word and become an “active” supporter by doing some of the leg work or becoming trained as a court watcher. 

 

 

 

More will follow as the plans go into motion and the call to action is made. Be ready to do your part and together we will make a difference our posterity will be proud of. 

 

 

 

 

This is only the beginning of the journey to take back the country that has been stolen from us. Our nation was ordained to come forth when it did. There is no rational reason this nation was able to exist with the enormous obstacles against them, but for divine intervention. The blood of sacrifices that have come before us will all be in vain if we fail them today. 

 

 

 

 

What are we willing to do to keep the promise of this free nation? Many of us have seen the movie “Saving Private Ryan”; the scene where Tom Hanks character was dying on the bridge and Private Ryan asks what he can do. He was told simply “earn this.” As with our fore-fathers, who paid the ultimate price to gain this freedom, we in turn must not “earn this.”
